Does MA law allow an employer to take unauthorized deductions from employees paycheck?

George (Guest) on Wednesday, October 31 2012, 03:09 PM
While at work I accidently ran the company fork lift in to some inventory. My employer has been deducting the expense from my paycheck even though I told them I do not authorize this. Can they just deduct this money?

No, an employer may not take any deduction for such damage, even if ostensibly authorized by the employee under the employer’s policies, unless there has been a court determination that the employee is responsible to the employer for the damage because the deduction violates the “special contract” provision of the Massachusetts Wage Act.
