My husband has depleted our checking accounts. Is this considered when we divorce?

My husband married me for my family’s money. We’ve been married for 5 years, and have 3 kids and assets totaling $2.5 M including a non-mortgaged home in Marlborough. He came into the marriage with next to nothing (less than $10K) and has depleted our checking accounts. Will the judge consider his actions and will he be entitled to half of remaining assets when we divorce?

    There are factors under Massachusetts law that a judge must consider when ordering a distribution of marital assets. These include length of the marriage and contribution to the marital enterprise as well as conduct during the marriage. This could include depleting marital bank accounts in an irresponsible way. Surely the judge would consider these factors when deciding on a distribution.
